Welcome to Build & Trim Fitness ("we", "us", "our", "the Gym"). These Terms & Conditions govern your use of our gym facilities, wellness services, membership plans, mobile application, and website (collectively referred to as "Services").

By enrolling as a member, purchasing a service, or entering our premises, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our Services.

Membership at Build & Trim Fitness is open to individuals aged 16 years and above. Members below 18 years require written consent from a parent or legal guardian.

• Membership is personal and non-transferable to any other individual.
• Members must carry their membership card or register via the app for facility access.
• Misuse or sharing of membership access will result in immediate cancellation without refund.
• We reserve the right to refuse membership to any individual at our sole discretion.
• Members must provide accurate personal details at the time of enrollment and keep them updated.
• Members with any pre-existing medical condition must obtain doctor's clearance before using any facility or service.

All membership fees and service charges are payable in advance as per the selected plan. Fees are subject to revision and members will be notified with a minimum of 15 days' notice.

• Membership fees are non-refundable once the plan is activated, except in cases of relocation or medical emergency (with valid documentation).
• Membership freeze/hold requests may be accommodated for a maximum of 30 days per year, subject to management approval.
• Late renewal beyond the expiry date will not include compensation for the lapsed period.
• One-time enrollment or registration fees are non-refundable under any circumstances.
• Additional services (personal training, therapy sessions, BCA tests) are billed separately and are non-refundable once availed.
• Returned or failed payments may attract a processing fee.

The health and safety of all members and staff is our highest priority. All members are expected to follow gym etiquette and safety guidelines at all times.

• Proper sportswear and closed-toe athletic shoes are mandatory inside the workout area.
• Members must wipe down equipment after use and return weights and accessories to their designated place.
• Aggressive, abusive, or threatening behaviour towards staff or other members will result in immediate membership termination.
• Consumption of alcohol, tobacco, or any prohibited substances on the premises is strictly prohibited.
• Members must follow all instructions from trainers and staff during sessions and therapy treatments.
• Build & Trim Fitness is not responsible for injuries sustained due to improper use of equipment or disregard of trainer instructions.
• Members using spa, sauna, steam room, ice bath, or any wellness therapy do so at their own risk and must disclose any relevant medical conditions beforehand.

Build & Trim Fitness is not responsible for the loss, theft, or damage of personal belongings brought onto the premises.

• Members are advised not to bring valuables to the gym.
• Digital lockers are available for use during your workout session; items left overnight are at the member's own risk.
• The gym and its management shall not be held liable for any personal injury, loss, or damage arising from use of equipment or facilities, except where such liability cannot be excluded by law.
• CCTV surveillance is operational 24/7 on the premises for security purposes.

Build & Trim Fitness operates every day from 5:00 AM to 11:00 PM. These timings may be revised on public holidays, special events, or for maintenance purposes.

• Members will be notified of any temporary closure or change in timings via SMS, WhatsApp, or the gym app.
• Access to specific areas (spa, sauna, therapy rooms) may require prior booking or slot allocation.
• Management reserves the right to restrict access to any area for maintenance, hygiene, or safety reasons.

Build & Trim Fitness offers a personalised gym application for membership management, attendance tracking, and service bookings. By using the app, you agree to the following:

• Login credentials are personal and must not be shared with anyone.
• We are not liable for service interruptions due to technical maintenance or third-party outages.
• Any content, data, or features on the app are the intellectual property of Build & Trim Fitness and may not be reproduced without written permission.
• Unauthorised access or attempts to tamper with the app or our digital systems will be treated as a violation and reported to relevant authorities.

Build & Trim Fitness reserves the right to suspend or terminate any membership, without prior notice or refund, in the following circumstances:

• Violation of any of these Terms & Conditions.
• Misconduct, harassment, or threatening behaviour on the premises.
• Misuse, sharing, or fraudulent use of membership access.
• Non-payment of dues or fees.
• Any activity that puts the safety, reputation, or operations of the gym at risk.

These Terms & Conditions are governed by the laws of India. Any dispute arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan.

We reserve the right to amend these Terms & Conditions at any time. Continued use of our services after any such changes constitutes your acceptance of the new terms.

At Build & Trim Fitness, we take the privacy and security of your personal information very seriously. This Privacy Policy explains what information we collect, how we use it, and the choices you have regarding your data.

This policy applies to all information collected through our gym facilities, website, mobile application, and any other Services we offer.

• To monitor attendance and track your fitness progress through the app.

• Service Providers: Trusted partners who assist in payment processing, app operations, or communications — bound by strict confidentiality agreements.
• Legal Compliance: When required to do so by law, court order, or a government/regulatory authority.
• Health & Safety: With medical professionals if there is an emergency on our premises.
• We will never share your health data with any insurance company or employer without your explicit written consent.

Build & Trim Fitness may photograph or record video of events, classes, or general facility activities for promotional use on social media, our website, or marketing materials.

• By using our facilities, you provide implicit consent to be included in such general media unless you formally opt out in writing.

• Personal transformation photos or before/after content will only be shared with your explicit written consent.

We retain your personal information for as long as your membership is active and for a period of up to 3 years thereafter, or as required by law.
